These Terms and Conditions govern your use of the app provided by ANCİENDA TEKNOLOJİ YAZILIM VE PAZARLAMA A.Ş., residing at Ayazağa Mah. Mimar Sinan Sk. No: 21A/13 Sarıyer/İstanbul.

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Ancienda.

We reserve the right to review and change any of these terms at any time. When we do so, we will update this page. Any changes to these terms will take effect immediately upon being published. For significant changes, we will notify you by email or by posting a notice on our website. These terms and conditions are effective as of 08.04.2024

Changes to Our Service and Pricing

We're always trying to improve the app, which means we might add, change, or remove features. We do not guarantee that you'll always be able to use the service in the same way, but we'll do our best to make sure you're happy with it. But there may come a time when we need to discontinue the service altogether. If that happens, we'll give you a month's notice, and you will have the opportunity to check your account.

We also reserve the right to change our pricing and usage limits at any time. If we do so, we will notify you by email and/or by placing a prominent notice on our website. Such changes will not apply retroactively.

Cancellations and Refunds

You can cancel your subscription at any time. Our default policy is not to offer refunds for the remaining time you had left. This means your subscription will not be renewed at the end of the subscription period. For example, if you are on a monthly plan and you cancel your subscription 10 days into the month, your subscription will end 20 days later, and you will not be charged again.

Limitations of Use

You are not permitted to:

use this website or its associated services in a way that disrupts or abuses our networks, or any other service provided by us,
transmit or publish any harassing, inappropriate, illegal, fraudulent, or offensive material using the app or its associated services,
use the app or its associated services in violation of any applicable laws or regulations,
use the app to send unauthorized advertising or spam,
collect user data without their consent using the app,
use this website or its associated services in a manner that infringes the rights of third parties, such as privacy or intellectual property rights.

Liability

The materials on the app are provided on an ‘as is’ basis. Ancienda makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights, factual accuracy or truthfulness. Ancienda does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

The app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the app won’t work properly or at all.

You should be aware that there are certain things that Ancienda will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Ancienda cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Ancienda cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Ancienda cannot accept responsibility.

With respect to Ancienda’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavors to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Ancienda accepts no liability for any loss, direct or indirect, you experience because of relying wholly on this functionality of the app.

Ancienda or its suppliers will not be hold accountable for any damages that will arise with the use or inability to use the materials on the app, even if Ancienda or an authorize representative has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations may not apply to you.

Force Majeure

Ancienda shall have no liability for delays, failure in performance, or interruption of service which result directly or indirectly from any cause or condition beyond our reasonable control, including but not limited to, any delay or failure due to any act of God, the act of civil or military authorities, the act of terrorists, civil disturbance, war, strike or other labor dispute, fire, interruption in telecommunications or Internet services or network provider services, failure of equipment and/or software, other catastrophe or any other occurrence which is beyond our reasonable control and shall not affect the validity and enforceability of any remaining provisions.

Indemnification

You hereby agree to indemnify, defend, and hold harmless us and our and directors, officers, employees, agents, representatives, partners, and contractors from and against all claims, losses, expenses, damages and costs (including, but not limited to, reasonable attorneys’ fees), resulting from or arising out of your actual or alleged breach of these terms, any content you provide through the app, or your use or misuse of the app. However, you will not be responsible for claims, damages, and costs which are found by a court of competent jurisdiction to have arisen solely from our violation of applicable law.

Right to Terminate

If you breach these Terms of Service, we reserve the right to suspend or terminate your access to our website and these Terms of Service immediately upon written notice to you.

Severance

If any part of these Terms of Service is found to be invalid or unenforceable, that part will be removed, and the remaining terms will remain in effect.

Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without giving effect to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of the Republic of Türkiye for any disputes arising out of or relating to these terms or your use of the app.
